McGuireWoods’ Regulatory & Compliance team deals with all aspects of regulation and regulatory compliance – regulatory approvals, permitting, siting, enforcement defense, rulemaking, legislation, project development, crisis management, and agency liaison, at federal, state and local levels.
The McGuireWoods Regulatory & Compliance practice group focuses on regulatory agencies, regulatory policy and regulated industries, primarily in the areas of energy and environmental law. This includes lawyers focused on all aspects of energy and utilities regulation, including natural gas and electric power, renewables, utility rates and regulation, transmission, electric market design and Regional Transmission Organizations (RTOs), utility facility siting and regulatory approvals, and regulatory compliance work for utilities, large and small independent producers, mining, telecom and many other types of energy companies and in regulated industries.
Our lawyers assist clients with compliance in day-to-day energy-sector operations as well as enforcement audits and investigations. This practice also includes energy regulatory aspects of transactions for the financing, development, acquisition and disposition of energy/utility assets. Our energy lawyers have been part of the evolving energy regulatory landscape for the past 50 years and we regularly represent energy clients in regulatory proceedings before state public utility commissions, the Federal Energy Regulatory Commission (FERC), the Environmental Protection Agency (EPA) and a host of other state agencies, covering a wide variety of federal and state energy regulatory statutes and compliance issues.
As part of the Regulatory and Compliance Department, our environmental practice group offers experience on every aspect of this area – from contaminated site clean-ups and due diligence reviews, to renewable fuel approvals and nanotechnology. We distinguish ourselves by focusing on broader client needs: preventing future problems, capitalizing on environmental assets, searching for more sustainable practices, helping the public understand the benefits of the client’s business activities – and forging innovative sustainability and green finance solutions.
With strong regional, national and international experience, we are thought leaders on emerging issues, like EPA’s proposal to reduce greenhouse gas emissions from power plants and extend its jurisdiction under the proposed “waters of the U.S.” rulemaking, and state efforts to restrict residual management (coal ash, animal waste and biosolids) for many of our anchor clients.
We have particular skill in transactions involving natural resource development, major manufacturing facilities and energy projects, and we offer significant depth of experience with organizing and managing groups of clients with common regulatory interests for an optimum outcome. In all these areas, we routinely use business and tax concepts to optimize project or transaction value.
Qualified candidates will have at least 2 - 5 years of practice experience, with either a civil litigation or regulatory background. Past experience in environmental law, at either the state or federal level, is strongly preferred. Position will involve supporting and building out a broad ranging, general environmental practice touching on the energy industry, real estate development, traditional heavy industry, and representation of investors and financial institutions. Anticipated work is expected to span all aspects of environmental law: advice under major federal and state environmental statutes; traditional and renewable energy development; civil and criminal enforcement; administrative law practice; and transactional support. Candidates must possess strong academic credentials as well as demonstrated organization, writing and communication skills, and an enthusiasm for working with a team.
