Position Summary
The Caribbean & Latin America Legal Group (CALA Legal) of Marriott International Inc.’s Law Department provides legal services to support operations, asset management, and the development of all Marriott-branded lodging products for owned, managed and franchised hotels in CALA Continent. CALA Legal supports the Company’s lodging and hospitality business and provides legal advice and counsel to the Company’s internal clients. The CALA Legal offices are located in the Company’s worldwide corporate headquarters in Bethesda, Maryland and in the CALA Continent headquarters in Plantation, Florida.
This position provides legal services in all phases of lodging developing within the CALA Continent to include lodging operations, employment issues, and franchise development. The attorney will assist Marriott to achieve its business objectives by working with various Marriott corporate departments and Continent disciplines.
This position is located at CALA Continent headquarters, Plantation, FL and will report directly to the Group Leader—Senior Vice President and Regional General Counsel, CALA.
Expected Contributions
The attorney selected for this position will provide legal services for the following areas, specifically:
Employment Law
- Support Human Resources professionals, hotel property and above-property managers and leaders by providing timely, ongoing, on-demand legal counsel and strategic guidance related to the management of employee issues, such as performance management, employee misconduct and workplace investigations, complaints and other employment claims, developing legally sound strategies for the Company’s defense of such actions, and negotiating and drafting settlements;
- Research, monitor and analyze labor and employment laws and regulations and advise Human Resources and management on the degree of risk associated with proposed initiatives, corporate activities and industry developments, recommending alternative courses of action to achieve business objectives while limiting liability and risk, and advising on pending law changes while creating proactive strategies to ensure compliance; and
- Manage and assist outside counsel in litigation such as wage and hour claims (to include class and collective actions) including making strategy decisions regarding depositions, discovery responses, witness preparation, and case resolution.
Lodging Development & Operations
- Provide advice on a myriad of operations and guest matters, including resolving contract interpretations issues and counseling on owner/franchisee matters;
- Provide preliminary advice on proposed franchise development transactions with respect to confidentiality agreements, structuring the transaction, letters of intent, and trade area restrictions;
- Draft and negotiate franchise and related agreements and coordinating various conversion matters on the takeover of existing properties, handling legal due diligence, coordinating with other members of the development team, oversee closings, and follow up on post-closing matters;
- Make judgement calls, provide feedback and guidance, supervise outside counsel, understand and resolve local law issues, provide advice to Continent field operators; and
- Provide advice on miscellaneous real estate matters affecting lodging development and operations (e.g., condemnations, easements, restrictions, and land use).
Candidate Profile
Successful candidates should possess the experience, knowledge, and skills as follows:
- Excellent academic records in college and law school, with a J.D. degree from a well-respected law school;
- Active Bar membership in any US state;
- Minimum of 5 years legal experience, preferably in employment law and providing advice and counsel to human resources and operating business managers in complex employment and labor-related matters;
- Demonstrated ability to deal with a broad array of topics and willingness to expand professional skills / receive training in order to provide legal support for all aspects of lodging operations and developing, in particular franchise development;
- Experience interfacing with government and/or labor and employment agencies which maintain jurisdiction over employment and labor-related legal matters;
- Experience as primary or second chair counsel in the litigation of employment and labor-related cases a plus;
- Experience with cutting-edge employment and labor-related policies, programs and systems, and up-to-date knowledge of labor and employment issues and case law;
- Strong leadership skills and good judgment, and the ability to think strategically both from a business and legal perspective;
- Excellent conflict management skills, and ability to influence without coercion;
- Proven contract drafting and negotiating skills;
- Ability to expeditiously identify and analyze issues and provide legally sound recommendations consistent with good business practices and reason;
- Ability to work under pressure;
- Strong organizational and time management skills; and
- Fluent Spanish language capability, including both verbal and written Spanish language strongly preferred.
