Principal Attorney The New York City School Construction Authority's (NYCSCA) mission is to design and construct safe, attractive and environmentally sound public schools for children throughout the many communities of New York City. An excellent opportunity for a Principal Attorney who will be responsible for providing legal advice and counsel to the various divisions of the Authority, but will predominately focus on public construction litigation and law.
Other Responsibilities: Providing advice and guidance on all matters arising out of the Authority's design and construction program. Coordinating with the New York City Law Department in the defense or prosecution of construction claims in New York State trial and appellate courts: developing legal strategy; responding to discovery and supervising litigation support staff; reviewing motions and appeals; attending mediations and negotiating settlements. Drafting multiple license agreements. Providing legal advice throughout the Construction Department on legal issues involving active construction. Enforcing construction contract terms including termination provisions and indemnity rights with sureties, drafting takeover and completion agreements. Creating, updating, analyzing and managing forms and legal documents for the procurement and administration of construction, design, consultant and vendor services. Managing a lien docket and defending lien foreclosure cases. Reviewing contracts to determine conformity with Authority policies and prepares contract changes. Advising on regulatory and administrative practice areas including the Authority’s MWLBE program, FOIL, labor and employment issues and conflicts of interest matters; representing the Authority in administrative hearings; drafting MOUs with other governmental entities. Counseling on legislative and policy matters, including: examining and commenting on proposed legislation; opining on the applicability of laws to the operations of the Authority; analyzing issues of law and making recommendations regarding the development of relevant policies and procedures.
Requirements: Juris Doctor and ten (10) years of full time diverse legal experience, post bar admission in one of the following areas: business contracts, construction contracts or general litigation.
Weighted Consideration will be given to candidates with: Bachelor's degree from an accredited college or university. Juris Doctor Degree from an ABA accredited law school; and admitted to practice law in New York State and be a member in good standing of the State Bar of New York on the date of hire and throughout employment; and ten (10) years of full time diverse legal experience in a law firm, corporate legal department, and/or government agency handling construction litigation, contracts, and governmental matters.
