We are currently searching for an action-oriented Litigation Counsel with a collaborative and pro-active leadership style to join our corporate law department in our Malvern, PA location. The successful candidate will have experience serving as a trusted business partner and a high degree of comfort interacting with business colleagues at all levels within the company, including executive leaders.
Independently support multiple Company businesses and provide day-to-day management of a varied caseload, including class actions, general liability, product liability and toxic tort claims, in numerous state and federal jurisdictions, as well as assist with a bankruptcy matter.
Regular communications with business personnel and insurance claim handlers; supervision of outside counsel; development and supervision of defense strategies; coordination of discovery responses, determination of settlement value of cases; and establishment of claim management protocols.
Review briefs and motions prepared by outside counsel and provide advice, comments, constructive feedback to experienced attorneys about case strategies, deposition tactics and documents to be filed.
General counseling to businesses on product warnings and federal regulatory issues as well as identification of potential business risks, and assessments for mitigation and avoidance of risk.
Guidance and stewardship regarding the manufacture, sale and handling of hazardous and regulated products.
Analysis of, and reporting on, assigned matters; analysis of claim and expense data to assist in forecasting legal spend and controlling outside counsel litigation costs to meet budgetary expectations.
B.A. or B.S. degree and a JD degree + admission in good standing to a state bar.
A minimum of 8-10 years of experience defending class action, product liability/mass tort cases; experience can be at a law firm or in-house. Experience managing other counsel, and knowledge of bankruptcy law preferred.
Communication - Excellent written and verbal communications skills and capable of working independently and providing advice and support to senior business personnel. Ability to clearly articulate to others proposals, case management updates, solutions to on-going litigation and claims, as well as innovative ideas for changing practices and procedures.
Strong Analytical Skills - Ability to identify key or underlying issues in complex situations, and develop innovative action plans for addressing current or future issues or opportunities.
Teamwork and Cooperation - Comfortable working collaboratively with others, being part of a team and promoting open working relationships with customers and business partners by facilitating beneficial resolutions to conflict while maintaining respect for differing points of view.
Achievement Oriented - Results oriented and can work collaboratively with other members of the Law Department, business partners, and outside vendors towards outcomes that meet or exceed business expectations.
Sound Judgement - Sound judgment in devising innovative litigation strategies and evaluating potential resolutions of cases. The person in this position must be able to assess complex fact situations and legal principles on an objective basis. Good judgment is a prerequisite.
Customer Service Oriented - Capable of acting as a partner to business clients while focusing on meeting business needs and possessing the agility to proactively provide creative solutions adapting effectively to change as facts and circumstances develop.
