This position provides informed legal advice to internal clients on legal matters within recognized area(s) of expertise and responsibility to preserve and protect the rights and interests of the company; provides practical legal advice to internal H.R. clients; manages outside counsel in agency claims and litigation; and provides guidance on real estate and Environmental, Health & Safety matters.
General (at all times): Maintains expert knowledge and awareness of legal precedent and developments and government regulations (federal, state and provincial) in employment law; and in environmental health and safety regulations relevant to manufacturing facilities. Note: This is not a Labor Relations position.
Budgeting and Reserves: Manages outside counsel fees; reviews invoices and case budgets; suggests appropriate reserves and settlements.
Legal Counseling (50%): Advises, counsels and assists internal Human Resources clients in promptly answering legal questions; provides practical guidance within acceptable levels of business risk; reviews employee policies and provides training on Employment Law matters.
Legal Guidance on Business Strategies (20%): Advises, counsels and assists internal Human Resources clients in planning and executing employee-related actions such as RIFs, benefits changes, facility openings or closures and performance reviews.
Defense of Claims/Litigation (20%): Directs outside counsel during all phases of claims/litigation defense in agencies and courts to protect CNH business interests in Employment and OSHA matters; occasionally drafts responses and position statements; develops and guides defense strategy in conjunction with client business goals; collects and reviews discovery and other information; assists in preparing company personnel for testimony; attends mediations, hearings and trials. Coordinates as needed with Workers Compensation Claims Coordinator but does not manage or defend Workers Compensation claims.
Purchasing (10%): Reviews supply/staffing contracts relating to hiring or consulting.
The qualified candidate will have:
J.D. Degree and a current member of the appropriate State Bar or ability to register as in-house counsel.
Minimum 10 years of legal experience with significant experience directly advising business clients regarding employment matters such as hiring, discipline, discrimination claims, accommodations, leave, employee performance and review.
Strong foundation of experience in areas of the law applicable to Company operations. Focus, experience and emphasis in Employment law is essential. Experience with environmental, OSHA and real estate matters is helpful.
Ability to travel within domestically to company facilities and offices may be required.

Regular and consistent attendance and ability/willingness to respond to clients and counsel beyond regular business hours.
