Antitrust/Competition, Corporate Generalist, General Commercial/Contracts Law
Provide guidance and legal support to Pepsi Beverages North America (PBNA) divisions in the United States, with a focus on PBNA’s business pertaining to local and national retail, restaurant, and convenience customers.
The role is located at PepsiCo’s White Plains, NY office. For convenience of NYC residents, shuttle services are available to/from Manhattan and to/from the White Plains train station.
Negotiate and draft complex national customer agreements with sophisticated retail, restaurant, and convenience customers
Engage cross-functionally and collaboratively to align on business objectives and lead execution of business goals in above referenced contracts and negotiations
Support PBNA’s ongoing compliance with applicable laws and regulations regarding retail sales operations.
Engage with internal business teams to help mutually resolve issues regarding existing or pending deals
Liaison with internal customer teams to address various business partner topics such as bankruptcy
Collaborate on the development and execution of new or enhanced contract execution processes with other internal departments (sales, finance, control, etc.)
Develop and present legal trainings regarding complex contract negotiations and critical retail issues to internal sales team, legal department and/other internal stakeholders
Respond to inquiries from internal customer teams on sales contracts and/or other retail matters.
Provide legal guidance on various key projects as they arise within PBNA business and the broader PepsiCo business
Daily engagement and collaboration with internal business teams (sales, finance, marketing, etc.) and various members of PepsiCo’s legal department
10+ years of top law firm and/or in-house experience with emphasis on antitrust counseling and/or transactional, with a strong academic record
The position has primary responsibility for counseling PBNA in connection with federal and state antitrust laws (including the Robinson-Patman Act), bottling and distribution laws, and pricing issues. Responsible for advising law department and supported business teams on a day-to-day basis on a variety of antitrust matters, including commercial agreements, and compliance issues, as well as partnering with the litigation legal team and outside counsel concerning antitrust claims that arise in the context of commercial litigation
Experience in consumer products recycling issues, specifically state bottle bills and beverages taxes preferred, but not required
Exceptional drafting and negotiation skills with excellent business judgment
Executive maturity for regular interaction with senior leaders. Strong strategic thinking, communication, influence and impact skills
Must be commercially-minded, a quick learner, and have the ability to effectively balance the provision of sound legal advice with the need for fast-paced, industry-competitive solutions. Collaborative style and proactive communication skills necessary
In-house experience with a consumer products company preferred, but not required
Excellent oral and written communication/presentation skills, organizational skills, attention to detail and analytical abilities. Ability to convey complex legal principles clearly and concisely
Strong interpersonal skills and ability to work collaboratively, with a solution-oriented approach, in teams within legal, business and functional areas
JD required, must be admitted to practice in the United States
