The Justice League counsels all businesses of DaVita and provides legal support for all transactions. Reporting to the VP, Associate General Counsel - Head of Litigation, the Head of the Office of Special Counsel will have responsibility for leading a team of attorneys and staff responsible for conducting privileged internal investigations and responding to investigations and litigation by government regulatory agencies related to regulatory compliance issues, including the False Claims Act, Anti-Kickback Statute, Stark Law and Foreign Corrupt Practices Act, and Qui Tam litigation. OSC attorneys are also responsible for managing outside counsel in these areas and interfacing with federal and state regulatory authorities conducting investigations or requesting information from the company.
KEY ACCOUNTABILTIES AND RESPONSIBILITIES
Provide legal advice on internal and government investigations, including those involving potential fraud and abuse, to the Company’s senior leaders, including the Chief Legal Officer, Chief Compliance Officer, Senior Business Executives, and the Board of Directors.
Provide leadership and supervision to a team of high-performing attorneys and legal professionals.
Manage and prepare budget, set team goals and metrics, and plan for future support needs.
Provide oversight and management over investigations and directly coordinate responses to inquiries from government regulators and investigators.
Conduct and manage privileged internal investigations concerning potential fraud and abuse allegations.
Effectively coordinate and collaborate with other departments and lanes involved in investigations.
Participate as a member of a litigation team and manage outside law firms and vendors for internal investigations and civil and criminal fraud litigation matters.
Responsible for development of internal processes and reporting.
Actively support the business through general legal counseling on compliance related matters in a wide range of complex legal issues.
Other duties and responsibilities as assigned including but not limited to:
Lead special projects.
Attend team meetings, phone conferences, and training as needed.
Know, understand, and follow teammate guidelines, employment policies, and department or company procedures.
Travel required: up to 20%.
J.D. Degree with a minimum of ten (10) years’ relevant work experience with a portion of this time spent in a law firm, government agency, or in-house in an investigation or litigation role in the healthcare, medical device or pharmaceutical industries.
Previous experience with healthcare fraud and abuse prevention laws; Medicare and Medicaid billing. and reimbursement requirements; and compliance issues for healthcare providers strongly preferred.
Previous criminal or civil litigation experience required.
Previous prosecution or civil litigation experience with federal or state government agency preferred.
Intermediate computer skills and proficiency in MS Word, Excel, PowerPoint, and Outlook required.
