The Compliance Counsel will have a cross-functional role focused primarily on ensuring that athenahealth operates with the highest standards of integrity, transparency, and trustworthiness.
The Compliance Counsel will be responsible for supporting the development, implementation and maintenance of athenahealth’s compliance program. This includes conducting risk assessments, proactively advising on compliance-related issues, handling compliance investigations, and management of training programs that promote employee understanding of and compliance with applicable laws, regulations, and company policies.
In addition, (s)he will be responsible for advising on risks and obligations that affect our hospitals and health system and medical group clients such as: HIPAA and state privacy regulations; fraud & abuse regulations; anti-kickback laws and regulations; Foreign Corrupt Practices Act; and patient safety.
Specific responsibilities may include, but are not limited to:
Proactively managing a high volume of compliance reports and project managing complex cases and investigations to successful resolutions
Independently investigating and acting on compliance issues, including leading internal investigations and any resulting corrective actions with all company departments
Producing astute issue resolutions that support corporate strategy and ensure athenahealth service offering compliance
Travel to different company locations to administer compliance training, advise on compliance issues, or investigate issue reports on an as needed basis
Maintaining the company’s compliance program to ensure adherence to applicable federal and state laws and regulations, industry standards, and corporate policies
Developing and coordinating multifaceted educational compliance training programs
Creating effective policies for appropriate response to non-compliant behavior by company employees, vendors, and clients
Engaging with leadership in the development of a relevant, thorough, and geographically-minded compliance program
Preparing detailed compliance reports and presentations (including statistical analysis of issue reporting) for submission to management, the Audit Committee, and government agencies as necessary
Education, Experience, & Skills Required:
J.D. from a well-recognized law school, with excellent academic credentials
2-4 years’ experience in healthcare law or compliance, preferably at a large law firm
Strong legal research and writing skills
Strong organizational and time management skills, with the ability and willingness to spend the time necessary to meet demanding deadlines and adjust to shifting priorities
Self-starter with a demonstrated ability to work independently
Superior verbal and written communication skills
Ability to think creatively and strategically, employing both business acumen and legal skills
Ability to work collaboratively with a cross-functional legal team and to adapt quickly to changing circumstances and team dynamics
Ability to maintain poise and a sense of humor in stressful situations
