Responsibilities will include, but are not limited to, the following:
Providing proactive and day-to-day advice on government pricing issues and government price reporting matters, including federal contracting requirements, pricing and reimbursement advice, Medicare (Parts B and D), Medicaid and other Public Sector Reimbursement Programs (e.g., PHS 340B, DOD Tricare, Veterans Affairs FSS);
Ensuring that the U.S. Market Access team complies with applicable laws and company policies, including the Anti-Kickback Statute and other U.S. healthcare compliance laws and regulations, antitrust, and FDA requirements;
Advising on strategic pricing and contracting proposals and other initiatives, including sitting as member of the pricing committee(s);
Identifying and analyzing legal risks and proposing appropriate actions to ensure compliance with relevant rules, regulations, and policies;
Interacting with and advising senior business leaders in the United States concerning legal issues that effect on the company;
Providing advice on market access agreements, which may include discount and rebate agreements, distribution agreements, as well as agreements with the Department of Defense and the Department of Veterans Affairs, and other innovative contracting agreements (e.g., value-based contracts);
Ensuring that the U.S. Market Access team is kept abreast of all relevant legal developments in the area of pricing and contracting by providing training and periodic updates;
Contributing to the achievement of clients’ business objectives;
Serving as the Legal Department representative on cross-functional teams, as assigned; and
Coordinating with and supporting other members of the Celgene Legal Department.
Qualifications Skills/Knowledge Required:
JD from an ABA accredited law school.
Admission to and in good standing with the bar of NJ.
A minimum of 5-7 years’ legal experience in the pharmaceutical, biotechnology, or medical device industry. Prior work experience in both a law firm and in-house is strongly desired.
Experience must include counseling on discount, pricing, and contracting matters (including Medicaid Drug Rebate Statute, Veterans Health Care Act, Average Sales Price, Average Manufacturers Price and 340B program), and on anti-kickback, safe harbors, and fraud and abuse matters.
Experience participating in pricing review board or advising on pricing review board discussions required.
Ability to appropriately balance legal and business risks while complying with short turnaround cycles;
Excellent skills in drafting and analyzing contractual terms.
Must have excellent verbal and written communication skills.
