Review and provide legal advice relating to high profile EPC, design, engineering, design-build and construction contracts, subcontracts, bids, and equipment agreements;
Review and modify industry standard (AIA, EJCDC, DBIA) and owner drafted contracts as necessary;
Provide legal advice relating to contracts, claims, project implementation issues, and general corporate matters;
Work with executive team to set the strategic direction of risk mitigation programs to align them with our growth and value creation visions and overall risk tolerances. Assist in conducting risk assessment of proposed and on-going contracts and projects;
Perform compliance, regulatory and insurance oversight and control, with a particular focus on professional engineering and contractor licensure at the firm level;
Support client development and securing work through pre-emptive contract development (especially on all constructed or integrated project opportunities) and by interfacing directly with clients, client legal teams, or our internal client development team.
Provide Executive Team and Project Leadership with good counsel, including providing project-level contract guidance and support (contract reviews, contract adherence, project guidance, major sub-contract preparation, T&C modifications, contract form maintenance) throughout the project life cycle;
Provide pre-claim strategies to protect projects and investigate, manage, and prepare contract claims;
Provide executive guidance in handling all forms of project-related dispute resolutions (client discussions, liens, discovery, mediations, arbitrations, litigation, settlement agreements, etc.), including coordinating with outside counsel when necessary;
Collaborate, align, and communicate as a liaison to the Barry-Wehmiller corporate team on risk mitigation, dispute resolution, and insurance matters and communicate contract policies/procedures to staff;
Position will report to Design Group CFO, and Barry-Wehmiller VP & Corporate Counsel;
Perform other duties as needed requested by executive team.
The candidate will ideally have 7-10 years of legal experience. Preferred candidate will have a background in either EPC, engineering or construction contracts and disputes within a law firm or an in-house legal department setting
Knowledge of construction-related insurance practices including professional liability insurance
Experience and skill in drafting and negotiating engineering, design-build, EPC and construction contracts
Results-oriented, highly collaborative, pragmatic, flexible, takes initiative, and creative
Sound legal reasoning, thoroughness, and excellent legal writing skills and presentation skills
Capable of building partnerships internally, building teams and effectively operating within teams
