The Legal Department’s Employment Law Group is seeking an attorney to advise its Human Resource clients on employment law compliance and dispute resolution and manage employment law administrative charges and complaints. The position will directly support Capital One’s HR Operations team, which includes employee complaint investigation and resolution, payroll and wage payment, on-boarding, background screening, and global mobility. The position will also oversee investigation of and responding to employment law administrative charges and complaints filed with federal, state, or local agencies.
Candidates for this position must have a thorough understanding of and experience providing legal advice regarding employment investigations and dispute resolution, discrimination, retaliation, leave, accommodations, wage payment, and background screening. This attorney will be expected to partner closely with Human Resource clients to deliver effective solutions to a myriad of legal issues in each of these areas. This position will report to the Senior Director for the Employment Law Group.
Responsibilities include, but are not limited to: - Counseling internal clients on investigation and resolution of employment law complaints; - Overseeing investigation and resolution of employment law administrative charges and complaints; - Counseling internal clients on payroll and wage payment requirements and issues under federal, state, and local law; - Counseling internal clients on legal requirements associated with employee on-boarding and background screening; - Collaborating with an internal team of legal professionals, a network of outside counsel, and business clients to deliver effective solutions to employment law issues; and - Partnering with business clients to proactively identify legal risks relating to employment law issues and develop and adopt practices and measures that ensure legal compliance and mitigate these legal risks.
Basic Qualifications: - Juris Doctorate (JD) with admission to at least one state bar - At least 4 year’s experience giving legal advice on employment law
Preferred Qualifications: - At least 6 years of relevant experience in a major law firm or Fortune 500 company in-house legal department - Experience providing significant legal advice to clients in the financial services industry regarding employment discrimination and retaliation, employment law investigations and dispute resolution, investigating and responding to employment law administrative complaints, payroll and wage payment requirements, and medical and other forms of leave and accommodations under federal, state, and local law - Outstanding judgment - Ability to work effectively both in teams and independently, make effective and integrated decisions, and collaborate effectively with associates at all levels in the company - Excellent written and oral communication skills with the ability to influence others - Ability to deal with ambiguous situations, complex concepts and details - Analytical and problem solving skills
