The Marriott International Law Department services the Company's lodging business. The Employee Benefits Practice Group ("Group"), a part of the Labor, Employment and Benefits section of the Law Department, provides legal advice and counsel to corporate and business unit clients regarding all legal aspects of the Company’s employee benefits and compensation plans and programs and related policies and systems.
The Corporate Counsel – Employee Benefits will provide legal advice and counsel regarding a broad array of employee benefits and compensation programs. The individual in this position will be required to make judgment calls and policy decisions regarding the Company’s positions and provide feedback and guidance accordingly. This is a newly created position that reports to the Group Leader, Vice President & Assistant General Counsel – Employee Benefits Law.
Specific Job Summary and Expected Contributions
The primary responsibilities of this attorney will be:
Drafting, legal research and analysis, plan design consultation and client counseling on:
Company-sponsored and Taft-Hartley qualified retirement plans;
Health and welfare plans;
Nonqualified deferred compensation and other executive compensation arrangements;
Equity compensation programs;
Severance and fringe benefit plans;
Payroll and pay practices; and
Cross-border benefit plans and programs.
Operational advice and general support to numerous departments and business units, including Human Resources, Corporate Accounting, Tax, Payroll, and Mergers and Acquisitions.
Participating in the development of legally sound policies and programs in all areas of employee benefits and compensation.
Maintaining working knowledge of all Company benefit plans and programs.
Responding to benefit plan claims and inquiries from participants and providers.
Following and advising Employee Benefits Department on changes in legislation and regulations impacting employee benefits and compensation.
Educating and advising fiduciary committees that oversee the Company’s employee benefit programs.
Assisting with government examinations or internal compliance audits.
Consultation and collaboration with the Tax Department regarding employee benefit related matters affecting corporate taxes and benefit plan audits.
Advice and assistance regarding benefits and employment matters in corporate M&A transactions and in hotel acquisitions and divestitures.
Negotiate and draft vendor services agreements for all of the above types of plans, programs and arrangements.
Successful candidates should possess the experience, knowledge, and skills as follows:
Excellent academic records with a law degree from a top law school;
Minimum of 5 years of substantive and applicable experience in employee benefits
Active Bar membership;
Strong competency in tax and ERISA aspects of the above-described plans, programs and arrangements. Knowledge of U.S. securities law requirements and international implications a plus.
Excellent drafting and negotiating skills with sound judgment, business acumen, and decision making capability.
Strong interpersonal skills, and ability to interact effectively and work diplomatically with individuals at all levels.
Ability to foster relationships and individual accountability across the organization.
Ability to work independently and effectively with the Company’s management, peers, and individuals representing franchisees and other parties.
Demonstrated ability to take ownership of and solve problems, to expeditiously assess issues, and to provide legally sound recommendations which are consistent with good business practices and common sense.
