The DaVita in-house legal team is known as the “Justice League.” The Justice League is comprised of around 250 attorneys, paralegals, and professionals. The Justice League counsels all businesses of the company and provides legal support for all transactions. The attorneys are viewed as strategic business partners and work closely with each other and with senior management on a daily basis. This position will sit with the Office of Special Counsel (OSC).
The Office of Special Counsel (OSC) is a division of DaVita’s Justice League (Legal Department). OSC is responsible for conducting privileged internal investigations and litigation related to regulatory compliance issues, including the False Claims Act, Anti-Kickback Statute, Stark Law and Foreign Corrupt Practices Act. OSC attorneys are also responsible for managing outside counsel in these areas and interfacing with federal and state regulatory authorities conducting investigations or requesting information from the company.
GENERAL PURPOSE OF THE JOB
This attorney will i) conduct and manage internal investigations relating to legal and compliance matters including creating an investigation plan, interviewing witnesses, reviewing documents, and making recommendations to senior management; ii) handle and coordinate responses to inquiries from government regulators and investigators; iii) coordinate and support company litigation matters, including managing outside counsel; iv) conduct compliance exit interviews; and v) engage in special projects.
ESSENTIAL DUTIES AND RESPONSIBILITIES
The following duties and responsibilities generally reflect the expectations of this position but are not intended to be all-inclusive.
Conduct and manage internal investigations concerning potential fraud and abuse allegations
Handle and coordinate responses to inquiries from government regulators and investigators
Provide legal advice to senior management on fraud and abuse matters
Participate as a member of litigation team and manage outside counsel for civil and criminal fraud litigation matters
Conduct compliance exit interviews and follow-up investigations
Responsible for development of internal processes and reporting
Support the business through general legal counseling on compliance related matters in a wide range of complex legal issues
Other duties and responsibilities as assigned including but not limited to:
Manage departmental metrics
Lead special projects
Attend team meetings, phone conferences, and training as needed
Know, understand, and follow teammate guidelines, employment policies, and department or company procedures
Travel required: up to 20%
Education, licenses, certifications, and experience required to fulfill the essential duties, include computer skills as required.
Juris Doctor degree required
License to practice law in a minimum of one state required
Minimum of four (4) years’ practicing legal experience required
Previous experience with healthcare fraud and abuse prevention laws; Medicare and Medicaid billing and reimbursement requirements; and compliance issues for healthcare providers strongly preferred
Previous prosecution or civil litigation experience with federal or state government preferred
Previous criminal or civil litigation experience preferred
Intermediate computer skills and proficiency in MS Word, Excel, PowerPoint, and Outlook required
