To provide privacy-related legal support and advice on US commercial, advertising, marketing, data analytics, information technology and digital privacy related matters, and develop related training and policies, guidelines and procedures for monitoring internal compliance.
•Legal advice and support - Provide privacy-related legal support on commercial, advertising/marketing, digital and information technology US privacy issues including opt-out choices, CAN-SPAM, TCPA, social networks, website and mobile privacy disclosures, data analytics/big data, data breaches, and emerging online technologies. Support business/transactional counsel with the review and negotiation of privacy language with vendors as needed, particularly for advertising/marketing and digital privacy issues. Manage outside counsel on privacy issues, particularly those related to advertising/marketing and digital issues, as needed. •Policies and Procedures - Create and implement policies and procedures related to commercial, digital, and advertising/marketing privacy issues within the respective business operations •Risk Assessment - Review company practices for compliance with US privacy and data protection laws, as well as company policy. Develop procedures for monitoring compliance with US data protection regulations and internal policies, particularly with regard to commercial, advertising/marketing, and digital issues, within the respective business operations. Conduct privacy risk assessments as needed. Partner with respective business operations to implement remediation measures as needed. •Training – Develop and conduct appropriate privacy trainings within the respective business operations and ensure competency •Third Party Management - Work with other members of the US Privacy Team to develop procedures for management of 3rd party vendors with access to Novartis’ personal information in compliance with US privacy and data protection laws and regulations •Best Practice/Knowledge Sharing – Ensure up-to-date knowledge of latest trends in privacy in assigned area. Provide support to and share experiences across US Privacy team and legal functions, as needed.

•Data privacy policies relevant to local business issues are in place and effectively employed •Guidance is provided to business and legal partners in a timely manner •Privacy policies, procedures, trainings, etc. are implemented in the respective business operations at the direction of the US Head Data Privacy •Business units are trained on legal requirements and internal policies •Privacy compliance issues are properly addressed; •Active participation in the Novartis privacy network
Ideal Background (State the preferred education and experience level)
•Juris Doctorate (J.D.) or equivalent Law Degree required •>5 years legal counselling experience, including US privacy and data protection experience, preferably from within a major international law firm or multi-national corporation.
Technical Skills/Knowledge: •Strong knowledge of the US advertising/marketing and digital privacy issues, including CAN-SPAM, TCPA, FTC, and data analytics/big data. •Knowledge of the US privacy and data protection laws with a focus on advertising/marketing and digital issues •Strong track record of identifying potential privacy risks/ issues and developing business-friendly solutions •Demonstrated track record of drafting and implementing policies and procedures. •Strong experience in designing and implementing effective training programs •Outstanding writing skills required to draft/edit policies
